DISTANCE SALES AGREEMENT

2. SUBJECT AND SCOPE OF THE AGREEMENT

The subject of this agreement is to determine the rights and obligations of the parties within the scope of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the sale and delivery of products ordered by the BUYER electronically through the SITE.

The BUYER acknowledges that they have been informed about the basic characteristics of the products, the sales price, payment method, delivery conditions, and the right of withdrawal before completing the order; and that they placed the order after reading and approving this information.

The pre-information form, order summary, and invoice provided before the payment page on the SITE are integral parts of this agreement.

The prices announced on the SITE are sales prices. Prices and campaigns are valid until updated or changed. Prices and campaigns announced for a limited time are valid until the end of the specified period.


3. PRODUCT AND ORDER INFORMATION

The type, quantity, sales price, total price including taxes, shipping or logistics fee if any, and payment information of the products subject to the contract were shown to the BUYER at the order stage and approved by the BUYER.

Basic information about the products is available on the SITE and this information is an integral part of this agreement.

The sales price of the goods or services and any additional costs are clearly communicated to the BUYER before the order is completed.

Shipping or logistics transportation costs belong to the BUYER, unless otherwise stated. If free delivery is provided within the scope of the campaign, this cost is covered by the SELLER.


4. PAYMENT AND CARD SECURITY

Payment transactions are carried out through secure payment infrastructures.

Critical payment information belonging to the BUYER, such as credit card, debit card, expiration date, and CVV, are not viewed, recorded, or stored by the SELLER.

Information used during payment transactions is processed through the secure systems of the relevant bank or payment institution.


5. DELIVERY AND PERFORMANCE

·       The SELLER delivers the product subject to the order to the address specified by the BUYER, depending on stock availability and after the product price has been collected, not exceeding the legal period of 30 days.

·       Unless otherwise specified, delivery costs belong to the BUYER. If free delivery is provided within the scope of the campaign, these costs are covered by the SELLER.

·       During delivery, products and packaging must be checked upon receipt. If the outer surface of the package has signs of crushing, tearing, wetting, or impact, or if damage is noticed on the product, a Damage Assessment Report must be prepared by the cargo or logistics personnel before the product is accepted.

·       Transport damage claims without a damage assessment report will be evaluated separately by the SELLER.

·       Delivery made to the person at the address specified by the BUYER shall be deemed as delivery made to the BUYER.

·       If the BUYER requests shipment with a carrier other than the one designated by the SELLER, the SELLER is not responsible for any risks that may arise.

·       The BUYER is responsible for any additional costs that may arise due to the BUYER not being present at the address, delaying delivery, or not accepting the product.

·       If the product price is not paid for any reason or if the payment is canceled in bank records, the SELLER's delivery obligation ceases.

·       If the SELLER cannot make the delivery on time due to force majeure or unforeseen circumstances, they will notify the BUYER.

·       If it becomes impossible to supply the product subject to the order, the SELLER will notify the BUYER in writing within 3 days from the date they learn of this situation and refund the collected amount to the BUYER within the legal period.


6. RIGHT OF WITHDRAWAL AND RETURN PROCEDURE

6.1. Right of Withdrawal Period

The BUYER has the right to withdraw from the contract without giving any reason within 14 days from the delivery of the product to themselves or to the person or entity at the address they indicated.

6.2. Exercise of Right of Withdrawal

To exercise the right of withdrawal, written notification must be given to the SELLER within the 14-day period. Notification can be made via the contact form on the SITE or to the email address hello@studiohane.com.

The product to be returned within the scope of the right of withdrawal must comply with the return conditions specified in this agreement.

6.3. Product Nature and Return Conditions

Many of the products on the SITE are made from natural and craft-oriented materials. Differences in color, texture, grain, weave, and form may be observed in natural wood, marble, ceramics, rattan, hand-knitting, and similar materials.

These differences are natural and characteristic features of the product; they are not considered defective products on their own.

Products to be returned within the scope of the right of withdrawal must be:

  • unused,
  • undamaged,
  • maintaining their resalable quality,
  • complete with their original packaging, protective packaging materials, and all accessories if any,
  • packaged in a way that will not be damaged during return transport.

Invoice or order information must be shared during the return process.

Returns are not accepted in the following situations:

  • Products showing signs of use or having lost their resalable quality
  • Products sent without their original packaging and protective packaging elements
  • Products damaged due to inadequate or incorrect packaging during return shipment
  • Special order products prepared with personalized measurements, colors, finishes, fabrics, or design changes

6.4. Return Process

For a return request, specifying the order number, name-surname, and the product to be returned is sufficient.

If deemed necessary, additional information or visuals regarding the product or packaging may be requested.

After the return request is approved, the appropriate shipping method for the product will be communicated to the BUYER. Return shipment must be made according to the SELLER's instructions.

The SELLER is not responsible for any damage, loss, or additional costs that may arise from shipments made without the knowledge and guidance of the SELLER.

6.5. Return Shipping and Transport Fees

Within the scope of the right of withdrawal, for returns made without any defect or incorrect product shipment, the shipping and transport fee belongs to the BUYER.

For products requiring special transport, the return transport method and transport fee may vary depending on the nature of the product and the delivery address. This amount will be shared with the BUYER before the return process is initiated.

In cases of defect, missing part, or incorrect product shipment originating from the SELLER, the shipping and transport fee related to the return is covered by the SELLER.

6.6. Refund

After the returned product reaches the SELLER, necessary checks are performed.

The price of products whose compliance with return conditions is approved will be refunded to the BUYER within the legal period and at the latest within 14 days, using the payment method used in the order.

The time it takes for the refund to reflect on the account or card may vary depending on the bank's processing procedures.

For products that are not found to comply with return conditions, no refund will be made, and the product may be sent back to the BUYER.


7. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:

  • prepared in line with the BUYER's requests or personal needs,
  • with special measurements, colors, finishes, fabrics, or design changes,
  • produced on order or customized

products.

For products within this scope, the special order nature may be additionally stated on the product page or during the ordering process.


8. GENERAL PROVISIONS

The BUYER acknowledges that they have been informed about the basic characteristics of the product, the sales price, payment method, delivery conditions, right of withdrawal, and return conditions before placing an order.

If the SELLER cannot fulfill its obligations under the contract on time due to force majeure or unforeseen circumstances, it will inform the BUYER.

The SELLER reserves the right to make changes to the content, design, product information, and services on the SITE.

In matters not regulated in this agreement, the provisions of Law No. 6502 on Consumer Protection, the Regulation on Distance Contracts, and relevant legislation will apply.


9. RESOLUTION OF DISPUTES

In disputes arising from this agreement, Consumer Arbitration Committees are authorized within the monetary limits announced by the Ministry of Trade; for disputes exceeding these limits, Consumer Courts are authorized.


10. EFFECTIVENESS

The BUYER is deemed to have accepted all terms of this agreement when they confirm their order and complete the payment through the SITE.

This agreement enters into force upon its approval by the BUYER in electronic environment.
